O FUTURO CHEGOU: REGULAMENTAÇÃO DO USO DE VEÍCULOS AUTÔNOMOS NO BRASIL

Abstract

This study aims to present an analysis of a possible regulatory model for Autonomous Vehicles in Brazil, in order to enable the implementation of technology and its socioeconomic development. This research is justified to the extent that, according to Ferry (2015), innovation tends to generate fear and resistance to consumers, but that it cannot be used as a mechanism that makes technological advancement unfeasible. As for the research problem, it is questioned which would be the best regulatory model to be adopted by the country and which would be the points that deserve greater attention by the regulatory body in order to satisfactorily meet the constitutional bases of the economic order. The deductive scientific method is used, as the focus was to identify the challenges for the implementation of Autonomous Vehicles in Brazil. However, the research method is renewed, with classical deductive hermeneutics being abandoned, but built from the theoretical bases of Sociology as a reflection tool that provides a dialogue between social and economic development. To this end, an analysis was carried out from a sociological perspective from the studies of Toffler (2001) and Castells (2005), which defined how contemporary society evolved into the era of access and information, and how the Fourth Industrial Revolution and the use of Artificial Intelligence may be a mechanism for the economic development of countries in the view of Schwab (2016) and Sen (2009). Then, it was presented how countries have reacted to the use of Autonomous Vehicles, the impacts of its implementation on the economy, according to Clements and Kockelman (2017), and, based on the research by Carp (2018), it was concluded that the the best mechanism to be adopted is the adaptive approach for providing the necessary security without making the technology unfeasible.
