Abstract

The present work is at the heart of the analysis of the National Financial System and the regulation of cryptocurrencies. Such focus is given by the high growth in the use of cryptocurrencies, as well as, by their high valuation. This time, an analysis is made of the State's intervention in the economy, in the light of the Federal Constitution, as well as on the theory of regulation. Afterwards, a complete approach is made about cryptocurrencies, describing their concept and functioning through blockchain technology; in addition to the debate about its legal nature and the benefits and disadvantages of possible regulation. In continuity, it is understood what would be an information society, configured in a contemporary society influenced by the digital age; which brings reflexes of technology in some sectors of modern life, with an emphasis on currencies that are now and / or are moving towards the digital world. Finally, an analysis of the current stage of regulation of cryptocurrencies, going through the bills in progress in the National Congress; as well as, a detailed study of the National Financial System, addressing its structure, its opinions and memoranda on the regulation of cryptocurrencies; in addition to the analysis of the possible creation of digital currency by the Central Bank: CBDC (Central Bank Digital Currency).
