DESENVOLVIMENTO ECONÔMICO, TRABALHO E CÁRCERE: CONTRIBUIÇÕES TEÓRICAS ÀS POLÍTICAS PÚBLICAS LABORAIS DESTINADAS ÀS MULHERES NO COMPLEXO PRISIONAL DE APARECIDA DE GOIÂNIA

Abstract

Prison as a legal institute represented, when compared to the private and public revenge phases of criminal law, a major leap in the humanization of penalties. Even so, it remains a great challenge to consider its application in the light of human and fundamental rights, especially with regard to the social reintegration of the group of people who, having committed crimes, go through the criminal law network and receive incarceration as a punishment. In Brazil, this scenario is challenging, since in absolute numbers it is among the top five countries with the largest prison population in the world, with a significant part of this total being women, as seen in the Aparecida de Goiânia Prison Complex. Considering this, the present work aims to make a theoretical contribution on public policies aimed at the reinsertion of the prisoners of the Aparecida de Goiânia Prison Complex by working under the constitutional economic bias, establishing with the subject their relationship with economic development, the work and prison. With a qualitative approach, the present work used the bibliographic method for the theoretical support necessary to understand the concepts and institutes of economic constitutional law that are related to the theme under study, in which the works of Tavares (2011) and Mendonça (2020) were fundamental. A field research was also carried out with the application of an interview whose questionnaire used was the semi-structured one. As a result, it was found that the labor policies practiced in the Aparecida de Goiânia Prison Complex have been fruitful in providing opportunities for increased income and professional qualification of the profile studied, which necessarily leads to the conclusion that in the economic sphere, a public policy whose purpose is the reinsertion of women in prison situations has a positive impact and fulfills part of the constitutional principle regarding social justice.
