ATIVIDADE LABORATIVA DOS REEDUCANDOS NA UNIDADE PRISIONAL DE SÃO SIMÃO (GO): UM ESTUDO DE CASO SOBRE AS POLÍTICAS PÚBLICAS APLICADAS (NO PERÍODO DE 2018-2020) E SOBRE A VIABILIDADE DE SE ADOTAR O MÉTODO APAC

Abstract

The research carried out had as a legal framework the Criminal Execution Law of 1984 and the Federal Constitution of 1988, which regulated the issue of the prisoner's work during the period of imprisonment. In view of this new scenario, Public Policies must assume a prominent position in view of the preponderance of State action, as they are actions of the government to achieve certain objectives, within a certain time frame and, thus, comply with the principles and provisions of the rules cited herein. . The research aimed to investigate the re-socialization projects developed in the Prison Unit in the municipality of São Simão in the State of Goiás and the public policies applied in that prison unit. An attempt was also made to analyze the legal bases and public policies of re-socialization through work, to verify the efficiency of these measures in the realization of the fundamental right of human dignity and the social right to work. It is a qualitative research and dialogue with the theoretical body, through normative sources and data extracted from institutional websites and application of interviews with the representative of the Public Ministry, with the director of the prison unit and people connected with the projects of resocialization. In view of this scenario, a bibliographic review of authors on public policies, public security and social, human development was carried out. Research was also carried out in the Prison Unit of Simão / GO, where the existing rehabilitation projects were identified and examined and are in accordance with the provisions of the Penal Execution Law. Finally, a diagnosis was made about the situation of the São Simão Prison Unit, with regard to physical structure, location, number of agents, overcrowding, and, especially, about the professional reintegration projects, as they are being designed and executed. The survey results showed that the actions implemented since the creation of the Community Council were important. However, there are limiting factors, of which the following prevail: insufficient physical space, inadequate location and structure, reduced number of effective criminal police officers, and timid participation by the community and the local government. Thus, for now, the idealization of new projects and the inclusion of new detainees remains ineffective. In view of this, the trend of regionalization of prison units, and that a Program with similar paradigms, idealized recently by the General Directorate of Penitentiary Administration of the State of Goiás - DEGAP, can take a long time to be tested, approved and executed, as well as construction and structuring of regional and state prisons, it is necessary to consider the feasibility of applying the method called Association of Protection and Assistance to Convicts - APAC. It is a civil entity governed by private law, which operates as an auxiliary entity to the Judiciary and Executive branches. It presents sensitive points, of which the most criticized is the imposition of activities of the Christian religion, since the State is secular, and an eventual privatization of a function privately protected by the State, which is criminal execution. However, APAC can present itself as one of the solutions to be applied immediately and that presents results in less time, for specific cases, and, contrary to what the critics claim, always in conjunction with other public policies and, indispensably, under the den of the Public Power. According to data presented in this work, the penitentiary system suffers, before overcrowding, a very high rate of recidivism, parallel power of criminal factions, among other problems. Thus, actions that privilege the individual, the dignity of the human person, the full protection of the family must be applied.
