???metadata.dc.description.resumo???: Esta dissertação integra à linha de pesquisa Políticas Públicas e Desenvolvimento Regional do Programa de Mestrado Profissional em Desenvolvimento Regional do Centro Universitário Alves Faria (UNIALFA). A pesquisa teve como objetivo analisar as possíveis formas de cobrança da dívida ativa e verificar se o protesto extrajudicial pode ser utilizado como instrumento de uma política pública de desjudicialização que favorece o desenvolvimento regional por meio da cobrança da dívida ativa. Procurou-se, ainda, analisar as bases jurídicas que subsidiam a utilização do protesto extrajudicial como política pública dentro do processo conhecido como desjudicialização, visando realizar o resgate do crédito público e concretização do princípio da eficiência, do princípio do direito fundamental à boa Administração Pública e do desenvolvimento regional, com ênfase no desenvolvimento local. Trata-se de uma pesquisa de natureza aplicada; o objetivo é descritivo exploratório; o procedimento técnico é por meio do levantamento bibliográfico e análise de caso; e a abordagem do problema é qualitativa e quantitativa. Com o intuito de verticalizar os estudos, coletaram-se dados exclusivamente dos exercícios financeiros até o ano de 2018. Como suporte teórico do trabalho, utilizou-se das lições de Bucci (2006), Silva e Bassi (2012) sobre políticas públicas; de Pedroso, Trincão e Dias (2019) sobre desjudicialização; de Carlucci, Lucchesi e Teotonio (2013) sobre tabelião e registrador; de Almeida, Mello e Pugliese (2019) sobre histórico da atividade notarial e de registro; de estudos de Guimarães (2018) em revista especializada com dados sobre a contribuição das serventias no processo de desjudicialização; de conceitos de Freitas (2014) e Clark (2001) sobre desenvolvimento regional; de estudos de Kohama (2012) sobre Orçamento Público; de Amaro (2013) e Fabretti (2008) sobre dívida ativa; de Carvalho Filho (2015), Freitas (2014) e Muñoz (2012) sobre o princípio da eficiência e boa administração, além de dados do Conselho Nacional de Justiça (CNJ) e análise do julgamento da ADI 5135 pelo Supremo Tribunal Federal (STF). Na presente dissertação analisou se os interesses da municipalidade estão de fato sendo atendidos, porquanto a não utilização de um instrumento do protesto judicial é pernicioso para a consecução do interesse público, deixando de serem cobrados um volume considerável de recursos públicos anualmente, o que seria suficiente para alavancar o desenvolvimento regional com a criação e ampliação de políticas públicas de interesse da coletividade local. As premissas desenvolvidas neste estudo permitiram compreender melhor os conceitos estruturantes da política fiscal, notadamente a cobrança da dívida ativa e a relação que guardam com o desenvolvimento regional em vista da necessidade de concretização do interesse público fixados na Constituição da República Federativa do Brasil (CRFB), Constituição do Estado de Goiás (CE/GO) e na Lei Orgânica do Município de Quirinópolis (GO), rumo à realização do direito fundamental à boa administração e ao princípio constitucional da eficiência, e indicaram que a atuação do gestor público municipal, bem como a atuação dos demais atores envolvidos está aquém de suas possibilidades e em descompasso com a necessidade de responsabilidade fiscal, num contexto de crise fiscal.
Abstract: This dissertation is part of the Public Policies and Regional Development research line of the Professional Master's Program in Regional Development at Centro Universitário Alves Faria (UNIALFA). The research aimed to analyze the possible ways of collecting the active debt and to verify if the extrajudicial protest can be used as an instrument of a public policy of dejudicialization that favors the regional development through the collection of the active debt. An attempt was also made to analyze the legal bases that subsidize the use of extrajudicial protest as a public policy within the process known as dejudicialization, aiming to redeem public credit and implement the principle of efficiency, the principle of the fundamental right to good Public Administration and regional development, with an emphasis on local development. It is an applied research; the objective is descriptive exploratory; the technical procedure is through bibliographic survey and case analysis; and the approach to the problem is qualitative and quantitative. In order to verticalize the studies, data were collected exclusively from financial years until 2018. As a theoretical support for the work, we used the lessons of Bucci (2006), Silva and Bassi (2012) on public policies; Pedroso, Trincão and Dias (2019) on legalization; Carlucci, Lucchesi and Teotonio (2013) on notaries and recorders; de Almeida, Mello and Pugliese (2019) on the history of notarial and registration activities; studies by Guimarães (2018) in a specialized magazine with data on the contribution of utilities in the process of judicialization; Freitas (2014) and Clark (2001) concepts on regional development; Kohama's (2012) studies on Public Budget; de Amaro (2013) and Fabretti (2008) on active debt; de Carvalho Filho (2015), Freitas (2014) and Muñoz (2012) on the principle of efficiency and good administration, in addition to data from the National Council of Justice (CNJ) and analysis of the judgment of ADI 5135 by the Federal Supreme Court (STF). In the present dissertation, it analyzed whether the interests of the municipality are in fact being served, since the non-use of an instrument of judicial protest is harmful to the achievement of the public interest, failing to be charged a considerable volume of public resources annually, which would be sufficient to leverage regional development with the creation and expansion of public policies of interest to the local community. The premises developed in this study allowed a better understanding of the structuring concepts of fiscal policy, notably the collection of active debt and the relationship they have with regional development in view of the need to materialize the public interest set out in the Constitution of the Federative Republic of Brazil (CRFB) , Constitution of the State of Goiás (CE / GO) and the Organic Law of the Municipality of Quirinópolis (GO), towards the realization of the fundamental right to good administration and the constitutional principle of efficiency, and indicated that the performance of the municipal public manager, as well how the performance of the other actors involved is below their possibilities and out of step with the need for fiscal responsibility, in a context of fiscal crisis.
